2. Scope
These Terms & Conditions apply to all orders placed through the online store of Visuals by Eisenberg by consumers and businesses within Germany and the European Union.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
A business is any natural or legal person acting in the exercise of their commercial or self-employed professional activity.
3. Conclusion of Contract
The presentation of products in the online store does not constitute a legally binding offer but an invitation to place an order.
By completing the checkout process, the customer submits a binding offer to purchase the selected products.
The purchase contract is concluded only when the Seller accepts the order through an order confirmation, shipping confirmation, or delivery of the goods.
4. Prices and Payment
All prices displayed are final prices.
In accordance with Section 19 of the German Value Added Tax Act (UStG), no VAT is charged or shown on invoices (small business regulation).
Shipping costs, if applicable, are displayed separately during checkout.

5. Shipping and Delivery
Delivery is available within Germany and selected countries of the European Union.
Estimated delivery times are indicated on the respective product pages.
Should delivery delays occur, customers will be informed accordingly.
6. Pre-Orders
Selected products may be offered as pre-orders.
Pre-order products may still be in development, production, or preparation at the time of purchase.
Any stated delivery dates are estimates only.
Delays caused by production, material shortages, suppliers, logistics providers, or unforeseen circumstances may occur.
Customers will be informed of significant delays whenever possible.
7. Retention of Title
All goods remain the property of the Seller until full payment has been received.
8. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal.

9. Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to products:

clearly tailored to personal requirements,

personalized or custom-made upon request.
10. Collector Products
Collector products are intended exclusively for collecting, display, presentation, and decorative purposes.
They are not toys.
Not suitable for children under the age of 14.
11. Electronic Components
Certain products may contain optional electronic components, lighting systems, or be designed for electronic upgrades.
Such components are intended solely for decorative and ambient purposes.
Customers are responsible for following all safety instructions and operating guidelines.
The Seller shall not be liable for damages resulting from improper installation, modification, misuse, or unauthorized alterations, to the extent permitted by law.
12. Product Representation
Product images, renderings, mockups, visualizations, and digital previews are provided for illustrative purposes only.
Minor differences in color, material, texture, finish, lighting effects, or appearance may occur due to production processes, materials, display settings, or photography.
Such differences do not constitute defects.
13. Scope of Delivery
Trading cards, figures, display items, decorations, or accessories shown in product images are not included unless explicitly stated in the product description.
Only the items specifically listed in the product description are included in the purchase.
14. Warranty
Statutory warranty rights shall apply.
15. Liability
The Seller shall be fully liable for intent and gross negligence.
In cases of slight negligence, liability shall be limited to breaches of essential contractual obligations.
Liability for injury to life, body, or health remains unaffected.
Any mandatory liability under applicable law shall remain unaffected.
16. Intellectual Property Rights
All artwork, product designs, renderings, concepts, graphics, photographs, texts, visual content, and other creative works displayed on this website are protected by copyright and intellectual property laws.
Any reproduction, distribution, modification, publication, or commercial use without prior written permission from Visuals by Eisenberg is prohibited.
The purchase of a product does not transfer any copyright, trademark, design, or usage rights.
17. Use of Digital Content
Where digital previews, product images, or design materials are provided, they may be used solely for personal and non-commercial purposes.
Any redistribution, publication, reproduction, or commercial use without written permission is prohibited.
18. Online Dispute Resolution
The European Commission provides an Online Dispute Resolution platform:

Visuals by Eisenberg is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
19. Governing Law
These Terms & Conditions shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection rights in their country of residence.
20. Severability Clause
Should any provision of these Terms & Conditions be invalid or unenforceable, the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by the applicable statutory provision.
